These terms govern the use of efmLeague and the purchase of paid offerings.
These Terms of Service (hereinafter "Terms") apply to the use of the online platform and the online football manager game "efmLeague" (hereinafter "Platform") as well as to all contracts concluded via the Platform between the provider and the user.
Deviating terms of the user shall not be recognised unless the provider expressly agrees to their validity in writing.
The provider and contractual partner is alytica UG (haftungsbeschränkt), Marxstraße 12, 66740 Saarlouis, Germany, represented by Savas Yarar (hereinafter "Provider"). Full contact details can be found in the Legal Notice.
efmLeague is a browser-based online football manager game. In its core functions, the Platform is generally free to use (Free-to-Play).
In addition, the provider offers optional paid content and features. The Founder Pass is a one-off digital product granting the user permanent Founder status as well as the benefits and cosmetic content listed in the relevant product description. The description on the offer page valid at the time of contract conclusion is decisive for the scope of services.
Use of the Platform requires the creation of a user account. The user is obliged to provide truthful and complete information when registering.
The user must keep access credentials confidential and protect them from third-party access. Only one user account is permitted per person.
The presentation of paid offers on the Platform does not constitute a legally binding offer but an invitation to submit an offer.
By clicking the "Order with obligation to pay" button, the user submits a binding offer to purchase the respective product. The contract is concluded once the provider confirms the order or provides the product. The provider sends an order confirmation to the user by email.
The prices shown on the offer page at the time of the order shall apply. All prices are final prices and include the statutory value-added tax currently amounting to 19 %.
Payment is processed via the payment service provider integrated by the provider (Stripe). The terms of the respective payment service provider apply in addition. The purchase price is due immediately upon conclusion of the contract.
The Founder Pass is digital content. It is made available immediately after conclusion of the contract by unlocking it in the user account.
The user expressly agrees that the provider begins performing the contract before the withdrawal period expires. The user acknowledges that, upon commencement of contract performance, they lose their right of withdrawal (see the Right of Withdrawal).
Consumers have a statutory right of withdrawal. Details are set out in the separate Right of Withdrawal.
The provider endeavours to keep the Platform available without interruption as far as possible. There is no claim to permanent availability. Maintenance work, technical disruptions or circumstances outside the provider's control may lead to temporary restrictions.
The provider is entitled to further develop, adapt or discontinue the game and its features, provided this is reasonable for the user and the scope of services already acquired is not unreasonably devalued.
The user undertakes in particular
In the event of violations, the provider is entitled to remove content, temporarily suspend the user account or terminate the contract for good cause.
The provider is liable without limitation for damage arising from injury to life, body or health and for damage based on intent or gross negligence.
For damage caused by slight negligence, the provider is only liable in the event of a breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the German Product Liability Act remains unaffected.
The user agreement for the free user account is concluded for an indefinite period and may be terminated by the user at any time by deleting the account.
The acquisition of the Founder Pass is a one-off purchase and does not constitute a subscription. The right to extraordinary termination for good cause remains unaffected for both parties.
Information on the processing of personal data can be found in the provider's privacy policy.
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the user has their habitual residence remain unaffected.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
